# Terms of Service for podctl

These Terms of Service ("Terms") govern your access to and use of podctl, a native Kubernetes client application provided by Olib AI ("we", "our", or "us"). By installing, accessing, or using podctl, you agree to comply with and be bound by these Terms.

## License and Scope of Use

Subject to these Terms, Olib AI grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and execute podctl on compatible Apple devices that you own or control, in accordance with the Apple App Store Terms of Service.

## User Responsibilities and Cluster Access

podctl provides direct administrative and operational access to Kubernetes clusters configured in your environment. You acknowledge and agree that:

- You are solely responsible for ensuring that you possess the necessary authorization and permissions to access, inspect, modify, or delete resources in connected clusters.
- All actions executed through podctl (including pod deletions, replica scaling, rolling updates, chaos experiments, and database operations) are performed under your own cluster credentials and authority.
- Olib AI has no visibility into or control over your clusters and bears no liability for operational incidents, downtime, or misconfigurations resulting from your usage.

## App Store and In-App Subscriptions

podctl is distributed through the Apple App Store. Any purchases, subscriptions, renewals, or refunds are processed by Apple and governed by Apple's standard terms and payment processing rules. You may manage or cancel subscriptions at any time via your Apple ID account settings.

## Intellectual Property Rights

The podctl software, including all source code, graphical designs, trademarks, logos, documentation, and user interfaces, is the exclusive property of Olib AI and its licensors, protected by copyright and intellectual property laws.

## Disclaimer of Warranties

podctl is provided on an "as is" and "as available" basis without warranties of any kind, whether express, statutory, or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

## Limitation of Liability

To the maximum extent permitted by applicable law, Olib AI and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or operational continuity resulting from your use of or inability to use the application.

## Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Georgia and the United States, without regard to conflict of law provisions.
